Business Innovation and Investment Visa

Visa Refusals

Having a visa refused can be overwhelming and stressful. It can possibly prevent you from lodging future applications. However, in certain circumstances, it may be possible to appeal a decision made by the Department of Home Affairs (DHA).

The Administrative Appeals Tribunal(AAT) reviews decisions made by officers of DHA to refuse or cancel visas. The AAT also reviews decisions relating to approval and cancellation of sponsorship and nomination. This review provides applicants another opportunity for potential success and the AAT decisions are based on the merits of each particular case.

The AAT has the power to:

  • Affirm the DIBP’s decision
  • Vary the decision
  • Set aside the decision, and substitute it with a new decision
  • Return the matter to the DHA for reconsideration with specific directions

Visa Cancellations

Visa can be cancelled by the Minister of DHA in the circumstances of the following:

  • Non compliance with the conditions attached to the visa
  • Incorrect or false information provided (including failing to notify the Department of a change in circumstance)
  • Character issues

There are other situations that might lead to visa cancellations also. When DHA is considering the cancellation, they will send a notice of intention to cancel to the visa holder. Visa holder needs to act urgently due to strict time frame.

Lodging a review application needs to address the reason why the visa is refused or cancelled. Furthermore, a good research of migration legislation is a must to prepare for the argument.
